Terms and Conditions

Last updated: October 2026 (based on the version of 19 September 2024)

Welcome to Capiii! These terms govern the use of the website www.capiii.com and the Canva app "Video Captions by Capiii" (together the "Service"), operated by Kevin Michael Schindler, Lindenstrasse 8, 73035 Göppingen, Germany ("we", "us"). By using the Service you accept these terms. If you do not agree, please do not use the Service.

1. Access to the Service

Subject to these terms, you receive a non-exclusive, limited, non-transferable, revocable licence to use the Service for business or personal purposes. Each user needs their own account, and you are responsible for all activity on your account. Only one user may use the Service per account, and each user may only have one account.

2. Age requirement

Children under 13 (or the minimum age required to consent to the processing of personal data in their country) may only use the Service if a parent, guardian or other authorised adult (such as a teacher) agrees to these terms.

3. Credits (caption minutes)

The Service uses a credit system: credits are caption minutes that are deducted according to the length of the video you caption. New accounts receive 2 free minutes. Additional minutes can be bought as a one-time purchase (currently 12 minutes for USD 5); there is no subscription. Promotional or early-access credits may have special conditions. We may change the credit system and prices in the future; changes do not affect minutes you have already purchased.

4. Payment and billing

Payments are processed by our payment provider Stripe. Stripe's terms also apply to the payment process. All prices include statutory VAT where applicable.

5. No refunds; right of withdrawal

Purchased credits (caption minutes) are non-refundable and cannot be exchanged for cash, unless a refund is required by law. If something goes wrong with a video, contact us at support@capiii.com and we will look into it.

Right of withdrawal for consumers: if you are a consumer, you generally have a statutory 14-day right of withdrawal for contracts for the supply of digital content. When purchasing minutes, you expressly agree that we begin performing the contract (crediting the minutes to your account) immediately, before the withdrawal period expires, and you acknowledge that you thereby lose your right of withdrawal once performance has begun (§ 356(5) German Civil Code, BGB). Your statutory rights in case of defects (for example, if the Service does not work as described) remain unaffected.

6. Acceptable use

You may not, yourself or through third parties: (i) rent, sell, sublicense or otherwise make the Service available to third parties; (ii) copy, decompile, reverse-engineer or create derivative works of the Service; (iii) use the Service for benchmarking or to build a competing product; (iv) store or transmit viruses or malicious code; (v) use a VPN to circumvent geographic pricing or access restrictions; (vi) send spam; (vii) use data mining, extraction or scraping, including for machine learning; (viii) access the Service with automated tools; or (ix) bypass measures that restrict access to or use of the Service.

We do not tolerate the use of the Service to discriminate against others, in particular based on race, religion, sex, sexual orientation, age, disability, ancestry or national origin, or to incite hostility or violence. You are responsible for having the rights to the videos you upload.

7. Service availability and changes

We are constantly improving the Service, and features may change. We do not guarantee any particular quality, stability or availability. Preview or beta features may be limited, contain bugs, change or be removed at any time, and come without a service level agreement. Please use non-sensitive content when testing preview features.

8. Suspension and termination

We may suspend or terminate access to the Service if you violate these terms, and in that case delete the affected content and account. If your account was terminated because of a violation, you may not create a new account without our written permission. You can stop using the Service at any time.

9. Intellectual property

Unless stated otherwise, we and/or our licensors own all intellectual property rights in the Service and the website content. You may not copy, republish, sell, sublicense or redistribute material from the website. Your videos and the captioned results remain yours.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are only liable for breach of essential contractual obligations, limited to the typical, foreseeable damage. Otherwise, liability is excluded to the extent permitted by law.

11. Third-party licences

The Service uses fonts licensed under the SIL Open Font License (OFL) v1.1, including Lora (Copyright 2011 The Lora Project Authors, github.com/cyrealtype/Lora-Cyrillic), as well as Open Sans, Poppins and Open Sauce. More about the OFL: openfontlicense.org.

12. Links

The website contains links to other websites (e.g. Canva) that we do not control. We are not responsible for their content.

13. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of your country of residence remain unaffected. Nothing in these terms creates an agency, partnership or joint venture. If any provision is invalid, the remaining provisions remain in effect. We may amend these terms; we will inform you of material changes in good time.
